Ambiguity of Laws. Seen at the Open Days 2024 of the Academy of Fine Arts Vienna
It’s exam period which means a relatively high teaching load but also some time for reflection on achievements, taken and missed opportunities.
Retrospect

Which digital skills should we teach in times of #ai? Prof. Dr. Thomas Strasser provided us with his version of an answer.
Shirin Ghazanfari shared her thoughts on seizure of mobile devices.
Smart Fox
The Kick off of a new exciting research project we are involved in took place in Vienna this week: Smart and Federated Open Data eXchange of Citizen-based Data Donations for Clinical Research is a national project, funded by FFG on data donations in the Austrian Health System. The acronym is Smart-Fox and we have a corresponding mascot
My department is responsible for the legal analysis in the project.
UNIKO
The “Österreichische Universitätenkonferenz (UNIKO)” gave a new year reception in the “Erste Campus” and I was invited (I don’t really know why, btw). It as a great opportunity to listen to speeches of UNIKO’s new president Prof. Vitouch, and the ministers Polaschek and Kocher.
All of them spoke about University-budgets (that seem to be relatively OK for the next years) and all of them had something about digitalisation and #AI in their speeches.
Forum Datenrecht
Second edition of this format, organised (at the department’s side) primarily by Dr. Žiga Škorjanc.
More than 100 people registered in the audience and an exquisite panel and keynote speaker (Prof. Dr. Andreas Wiebe, LL.M.)lead to a very succesful event - both content- and networkingwise.
Books
The commentary on legal issues of fin-techs arrived physically in my office.
Žiga Škorjanc and me wrote the chapter on data protection.
And I heard that the book on “Rechtsdogmatik” finally made it into the bookshops - I haven’t seen a copy yet, though.
Here’s the table of content, my part ist on “Beyond Legal Dogmatics”.
Prospect
Patient Autonomy Conference
We are ahead of another major conference on digitalisiation, law and medicine. It’s going to happen next Tuesday, free registration is still open.
I am, in particular, happy about the opportunity to unite the European and the Austrian regulatory perspective with a patient/consumer oriented focus.
The panel:
Botschafter Prof. Dr. Martin Selmayr (Leiter der Vertretung der Europäischen Kommission in Österreich, Wien)
DDr. Meinhild Hausreither (Sektionsleitung Humanmedizinrecht und Gesundheitstelematik, BMSGPK)
Olaf Heinrich (CEO Redcare Pharmacy)
DI Arnold Herzog (Leiter Geschäftsfeldentwicklung und Verrechnung, AGES Medizinmarktaufsicht)
Dr. Gerhard Jelinek (Leitung der Wiener Pflege-, Patientinnen- und Patientenanwalt)
Leo Reisinger Memorial Event
Prof. Dr. Dr. Leo Reisinger (1944-1985) is one of the early fathers of legal informatics (in Austria and elsewhere).
He would have become 80 this year. Due to this occasion, the LLM-programme on information and media law is organising a memorial conference at UNIVIE-premises on Thursday, February 1, from 17.00 CET. I am chairing this event.
Free registration is still open.
Dr. Markus Holzweber collected some videos from Reisinger on “Computers at Home”:

“Wir plädieren dafür, Ethik und Werte nicht als Gegensätze zu einer demokratischen Gesetzgebung zu verstehen, sondern als notwendige Komponenten einer informierten regulatorischen Debatte, insbesondere in einem Regulierungsfeld, welches sich nicht allein durch juristische Argumentation bespielen lässt, sondern die nicht rechtlich determinierten, hoch komplexen Charakteristika von KI und Big Data zwingend berücksichtigen sollte.”
That’s a key sentence in a very interesting text published in “Verfassungsblog”. I have a conversation (in German) with its authors on Friday, 26/01, at 17.00 CET:
Dermatology (like radiology) is one of the medical field where one can clearly see already now how intzensely AI is changing daily routines but also research.
I will also have a recorded session, face to face in the laundry, with Julian Hessenthaler’s lawyer Dr. Oliver Scherbaum. We will analyze Hessenthaler’s trials that he is speaking abou in quite some detail here:
If things go as planned, I will publish this in the upcoming week.
Job Offer
There are many, many things happening in the department and in my life that I can’t report here, either because it’s too early or because they are confidential. Trust me, many of them are interesting. If you want to have a closer look into what’s happening behind the scenes (in this week, inter alia, a meeting in the ministry of justice, a meeting with several IT-industry holders, a meeting with EU representatives, lots of yearly appraisal meetings, a bowling session, a department-internal social run etc.) here is an opportunity to join:
This is a critcial position as it is about budget and money. The person coming has access to the heart of (almost) everything we are doing. So, if you love to see numbers and want to be in a strategically relevant position in an early career stage —> this is your opportunity.
Daisy
… sees the opportunities (and the challenges) coming.
(BTW: Many of the Daisy pictures (and also this one) are taken by my son Felix. He generously allows me to use them - but deserves proper credit.)
Have a wonderful week!
Kind regards
